How to become a Patent Agent — your road, class by class

Class 8 to working life·15 student doubts answered ·Last checked 25 Oct 2026

The one-line route: Science in Class 11–12 → a degree in science, engineering or technology → Patent Agent Examination (Paper I MCQ + Paper II descriptive + viva-voce) conducted by the Controller General of Patents, Designs & Trade Marks → register as a patent agent (Indian citizen, 21 or older). [1] [2]

Pick your class and the road below starts where you stand.

00 The job

What the work really is

A patent agent drafts and files patent applications and represents inventors before the Indian Patent Office. India's law calls this professional a patent agent (Patents Act, 1970, section 126); "patent attorney" is not a separate registration. [1] [2]

A normal working day

  • Read an invention and write its patent specification and claims.
  • File applications and reply to Patent Office objections.
  • Search earlier patents to check whether an idea is new.

Pay

Patent agents work for firms, companies or on their own; no official pay scale is published, so no figure is printed.

Main routes

Degree → Patent Agent Examination

Section 126 needs Indian citizenship, age 21, a degree in science, engineering or technology from a university in India (or an equivalent the Central Government notifies), and passing the qualifying examination. [1]

Ten years as a Patent Office examiner

Section 126 also lets someone who has worked at least ten years as an examiner or Controller register without the exam, after leaving that post. [1]

Trade Marks Agent (separate exam)

The same office holds a Trade Marks Agent Examination the day before; eligibility is under Rule 144 of the Trade Marks Rules, 2017. [2]

Time and cost

Exam fee
₹1,600 (Rule 109(3), Patents Rules, 2003) [2]
Registration after passing
₹3,200 registration + ₹800 continuation fee for one financial year (2026 qualifiers) [3]
Exam day
Paper I 2 h (MCQ, 100 marks) · Paper II 3 h (descriptive, 100 marks) · viva-voce 50 marks [2]

The Patent Office recognises no coaching institute — previous papers are on ipindia.gov.in.

Hidden challenges

  • You need 50% in each written paper just to reach the viva-voce. [2]
  • One exam a year: registration for PAE 2027 closed on 30 September 2026 and will not be extended. [2]
  • The syllabus is law: the Patents Act and Rules, the Designs Act and Rules, and IP jurisprudence. [2]

Who should not choose it

  • You have no science, engineering or technology degree — section 126 requires one.
  • You dislike reading long legal and technical documents.
  • You want a fixed government pay scale — patent agents work in private practice or companies.
01 Your road, stage by stage

What to do at each stage — and the doubts on the way

  1. You are here Class 8 · Class 9

    Science and writing

    • A patent agent must hold a degree in science, engineering or technology — so stay with science. [1]

Doubt What does a patent agent do?

Drafts and files patent applications and represents applicants before the Indian Patent Office. Registration is under section 126 of the Patents Act, 1970. [1]

Next: Read the Routes list above.

Doubt Is a patent attorney the same as a patent agent?

In India the registered professional is called a patent agent. The Patent Agent Examination and section 126 of the Patents Act set who may register. [1] [2]

Next: Use "patent agent" when you search official sites.

  2. You are here Class 10

    Choose Science

    • Pick a science stream in Class 11 that leads to a B.Sc, B.Tech, B.Pharm or similar degree. [1]

Stream / subjects: Science (PCM or PCB) — the degree must be in science, engineering or technology.

Doubt Can a Commerce or Arts student become a patent agent?

Not under section 126: the degree must be in science, engineering or technology. A law degree alone does not meet it. [1]

Next: Choose Science if this career interests you.

  3. You are here Class 11 · Class 12

    Plan a science degree

    • Choose a degree in science, engineering or technology from a university established by law in India. [1]

Doubt Which degree is best for patent work?

Section 126 accepts any degree in science, engineering or technology from a university established by law in India, or an equivalent the Central Government specifies. [1]

Next: Pick the science field you enjoy most.

Doubt Do I need a law degree?

No. Section 126 asks for a science, engineering or technology degree and the qualifying exam, not a law degree. [1]

    Next: Plan your science degree.

  4. You are here In college

    Study the Patents Act

    • Syllabus: the Patents Act, 1970 and Patents Rules, 2003; the Designs Act, 2000 and Designs Rules, 2001; matters related to IP jurisprudence. [2]

Doubt Can I write the exam in my final year?

Yes, but if you qualify you must submit a copy of your degree within six months of the final result to complete registration. [2]

Next: Plan the exam so your degree arrives in time.

Doubt Can I write the exam in Hindi?

Yes. You choose English or Hindi when you apply, and you cannot change it afterwards. [2]

Next: Decide your language before you submit the form.

Doubt Is there an official coaching institute?

No. The Controller General's office recognises no training institute; read the Acts and Rules and use the previous years' question papers on ipindia.gov.in. [2]

Next: Start with the bare Act.

  5. You are here Graduated

    Patent Agent Examination

    • Paper I: 2 hours, MCQs (one or more correct options), 100 marks. Paper II: 3 hours, descriptive, 100 marks. 50% in each paper → viva-voce (50 marks). [2]

    Exams that open here

    • Patent Agent Examination 2027 — 10 Jan 2027 · written result 2nd week Feb · viva last week Feb · final result 3rd week Mar 2027 [2]

Doubt When is the next Patent Agent Examination?

    10 January 2027 (Sunday), at 15 locations. Admit cards from 15 December 2026. [2]

Next: Registration closed on 30 Sep 2026 — watch ipindia.gov.in for the 2028 notice.

Doubt How much is the exam fee?

₹1,600, paid online. It is not refunded if you cannot take the exam. [2]

Next: Pay before the last date.

Doubt What marks do I need for the viva?

At least 50% in each written paper. The final "Qualified" result follows rule 110 of the Patents Rules, 2003. [2]

Next: Prepare for both papers equally.

Doubt Can I write both the Patent Agent and Trade Marks Agent exams?

Yes. They are held on different days (Trade Marks on 9 Jan, Patents on 10 Jan 2027); check your eligibility for each before applying. [2]

Next: Apply for both in the same window if you qualify.

Doubt What is the age rule?

You must have completed 21 years to be registered as a patent agent. [1]

Next: Check your date of birth against the registration date.

Doubt What happens after I qualify?

You apply in Form-22 with the registration fee (₹3,200) and a continuation fee (₹800 for one financial year), uploading proof of age, degree certificate (not provisional), citizenship and a gazetted officer's character certificate. [3]

Next: Keep your documents ready before the final result.

  6. You are here Working / switching career

Scientists and engineers switching to IP

    • Working scientists and engineers can sit the exam — there is no upper age limit in section 126. [1]

Doubt I work in R&D. Can I become a patent agent?

Yes, if you are an Indian citizen with a science, engineering or technology degree and pass the Patent Agent Examination. [1] [2]

Next: Apply in the next registration window.
