Patent Agent & Patent Attorney — Protecting Inventions

8 min read · Registered with the Indian Patent Office · Science, engineering or technology degree

A registered patent agent drafts and files patent applications and argues them before the Indian Patent Office. Anyone with a science, engineering or technology degree can qualify by passing the Patent Agent Examination run by the Controller General of Patents, Designs and Trade Marks (CGPDTM). A “patent attorney” in India usually means an advocate who is also a registered patent agent — so a law degree adds courtroom work on top.

Overview

What does a Patent Agent do?

  • Patent agents read inventions, search earlier patents, draft claims and specifications, file applications and respond to Patent Office objections.
  • They advise companies, universities and start-ups on whether an idea is patentable and how to protect it in India and abroad.
  • Technical depth matters: pharma, biotech, electronics, software-related and mechanical patents each need subject knowledge.
